On 16 February 2023, the Election Commission accepted the Eknath Shinde faction as the real Shiv Sena. Also, Shinde faction was allowed to use Shiv Sena’s name and symbol (bow and arrow). The Uddhav faction had challenged the Election Commission’s decision in the Supreme Court.
The Supreme Court on Monday (September 18) heard the disqualification of 16 MLAs of Shiv Sena Shinde faction. The court told the Assembly Speaker that you cannot postpone the decision on this matter for long. You have to decide its date line. After this the hearing of the case was adjourned for two weeks.
On the other hand, the court postponed the hearing of the case related to Shiv Sena’s name and symbol for 3 weeks. A bench of CJI DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra heard the case.
Supreme Court heard two cases
The Supreme Court on Monday heard two petitions regarding the ongoing dispute between Shinde and Uddhav faction. One of these petitions was related to the use of the party’s name and symbol. On the other hand, there was a review petition demanding disqualification of 16 MLAs of Eknath Shinde group. This was filed by Uddhav Thackeray group leader Sunil Prabhu.
Shiv Sena leader Eknath Shinde had rebelled against the party in June 2022. After this, Shinde formed the government in the state along with BJP and himself became the Chief Minister. After this Shinde staked his claim on Shiv Sena.
On 16 February 2023, the Election Commission accepted the Eknath Shinde faction as the real Shiv Sena. Also, Shinde faction was given permission to use the name and symbol (bow and arrow) of Shiv Sena. The Uddhav faction had challenged the Election Commission’s decision in the Supreme Court.
The Supreme Court had given its verdict about 4 months ago on the disqualification of 16 rebel MLAs of Eknath Shinde faction. In this, the court had left the decision on the membership of rebel MLAs to the Speaker. At the same time, Uddhav Thackeray faction leader Sunil Prabhu had filed a petition in the Supreme Court and appealed to reconsider the matter.
Assembly Speaker Rahul Narvekar had sent a notice to 54 MLAs of both factions of Shiv Sena to appear in the Central Hall of the Assembly for the hearing of the case.
Assembly Speaker held hearing on disqualification of MLAs
In Maharashtra, the hearing was held on September 14 on the petitions filed by Shiv Sena Shinde faction and Uddhav faction to disqualify each other’s MLAs. This hearing was conducted by Assembly Speaker Rahul Narvekar in the Central Hall of the Assembly.
According to news agency PTI, the hearing of the case took place on September 14 from 10:30 am to 2 pm. After this, Shinde faction’s lawyer Anil Sakhre told the media – We have not received documents from the Uddhav faction.
In response, Thackeray faction MLA Ravindra Vaikar said that this is part of the Shinde faction’s strategy. It is the job of the Assembly Speaker to provide documents related to the case to both the groups. We want that 34 petitions have been filed in this case, all of them should be combined and heard together.
During the hearing of the case, the MLAs of the factions were made to sit at different places in the Central Hall.
Speaker had sent notice to 54 MLAs
Assembly Speaker Rahul Narvekar had sent a notice to 54 MLAs of both factions of Shiv Sena to hear the matter. In which all the MLAs were instructed to appear in the Vidhan Bhawan. During this, MLAs of both the groups and their lawyers were present. At present, the hearing of the case has been postponed till next week.
What happened in the hearing on 14 September
During the hearing of the case, serial numbers were given to the lawyers of all the MLAs. He has been asked to provide his WhatsApp number and e-mail ID for further hearing and action. MLAs of both the groups were made to sit at different places in the Central Hall. After this their statements were recorded.

Elections were held on 288 assembly seats in Maharashtra in 2019. BJP became the largest party in the state with 106 MLAs. The alliance between Shiv Sena and BJP could not work out regarding the post of Chief Minister. Shiv Sena with 56 MLAs formed the government by forming Mahavikas Aghadi along with Congress with 44 MLAs and NCP with 53 MLAs.
Shinde was among the Shiv Sena leaders who were against forming a government with the Congress. In 2019, Uddhav made Shinde the leader of the legislature party. At that time it was believed that Shinde would become the CM of Maharashtra, but NCP and Congress wanted to make Uddhav the Chief Minister. In this way Shinde remained the Chief Minister of Maharashtra.
In May 2022, Maharashtra Government’s Urban Development Minister and Shiv Sena leader Eknath Shinde rebelled along with 39 MLAs. Eknath Shinde took advantage of Manipur’s Nabam Rebia case, in which the Supreme Court had formed the government of rebel MLAs. Shinde also gave notice of no-confidence motion against the Deputy Speaker in the Maharashtra Assembly, so that the Deputy Speaker could not take a decision on the disqualification of 16 MLAs of the Shinde faction.
Meanwhile, the Governor asked Uddhav Thackeray to prove his majority. Uddhav went to the Supreme Court against this, but the Supreme Court upheld the Governor’s decision. After this Uddhav resigned. The Governor has now asked the Shinde faction to immediately prove its majority.
